Undergraduate Declaration – Constitution III § 2 (3)

Undergraduate Declaration – Constitution III § 2 (3):

Redbook Section in Question:

Redbook Constitution or Bylaws?: Constitution

Redbook Article: III

Section: 2

Clause: 3

Requestor Information:

Name: Erik Bond

Position/Affiliation: Assembly Vice Chair

Chair Email: ebond@asuu.utah.edu

Date:

10/28/2025

Question (Be as specific as possible):

This language is pretty clear here, but this is more so a question of norms. People have been dissuaded from becoming undeclared, becoming the undergraduate seat for the assembly or senate, and then redeclaring. This is a practice that has happened in the past (see Milan Subotic), but has since been heavily scrutinized. However, now that students are becoming declared in their major as soon as they take the intro class for it, there is a much smaller pool of students who are undeclared in the university, and most are 1st year students. Due to this change of how the University as a whole decides who is declared and who isn’t, I would request formal permission to allow the practice of allowing students to undeclare, get appointed, and then redeclare their major as this section of the constitution is implied to allow.

Attorney General:

Text Section in Question:

Each Assembly Representative and Senator must maintain enrollment in the College to which they were elected during their entire term of office, excepting Representatives and Senators elected from Undergraduate Studies.

Interpretation:

Students may not undeclare, get appointed, and then redeclare their major. Doing so potentially risks disrupting a student’s academic trajectory and creates inequity among students, as some majors require acceptance while others are open enrollment.
